Kebab managers convicted of hidden work

They appeared before the criminal court of Saint-Martin.

One is the de facto manager, the other the manager of a kebab-type snack bar in Marigot. The two were summoned to the Criminal Court of Saint-Martin on Thursday October 26 for concealed work. The four people they employed were not reported.

At the hearing, only the legal manager was present. Manager of a DIY store in the Dutch part, he opened this snack shop in 2015 with his partner who ran a similar restaurant in Anguille.

The investigation had started when one of the employees, a Venezuelan, went to the gendarmerie to file a complaint against his boss. He accuses him of exploiting it. He claims to work more than 10 hours a day for 60 dollars. The investigations will confirm this and will bring to light the total absence of management of the company in accordance with the regulations, a company which is, however, registered with the commercial register of Basse-Terre. But there is no bank account, the four employees are not declared, have no employment contract and do not have a work permit for the French part, they are natives of Albania, Venezuela and Sint Maarten.

The manager in addition said he was surprised that "the government waited more than a year and a half to come and control the snack ...".

After deliberation, the court sentenced the two men to a two-month suspended prison sentence, a fine of 5 euros. He also issued a ban on carrying out a catering activity in the French part for five years.
