The Minister of Justice inaugurated the Saint-Barthélemy and Saint-Martin detached chamber

As of her arrival at the airport of Grand Case this Friday May 3 at 9 am, the Minister of Justice, accompanied among others by the prefect of Guadeloupe Philippe Gustin, went to Marigot, to the courthouse.

After having visited the detached room of the tribunal de grande instance (TGI) of Basse-Terre, and met the staff, Nicole Belloubet, with the presidents of the communities of Saint-Barthélemy and Saint-Martin, as well as the president of the TGI from Basse-Terre, unveiled the plaque of the detached room.

Then, on the floor of this detached room, the president of the TGI of Basse-Terre, Marie Bart, introduced the various speeches before magistrates, lawyers, clerks, Senator Guillaume Arnell, MP Claire Javois, as well as all the actors premises of the judicial chain.

"This detached room is the sixth in France and the second in Overseas (with Saint-Laurent du Maroni) and it will be the last detached room created since with the law on the judicial organization passed on March 23, 2019, the spare rooms will disappear on January 1, 2020. The detached chamber of Saint-Martin and Saint-Barthélemy will disappear but will be reborn to become with the district court, the proximity chamber of Saint-Martin and Saint-Barthélemy ”. The president of the COM of Saint-Martin then addressed three points which are close to his heart. First, judicial cooperation between the two parts of the island. Then the establishment of an Educational Home, with the support of the Directorate of Judicial Protection of Youth (PJJ). Finally, the construction, in Saint-Martin, of a remand center with a branch of the Penitentiary Integration and Probation Service (SPIP) of Guadeloupe: "I would like, perhaps after an in-depth mission of the General Inspection of Justice on the spot, that the State undertakes on the construction, within ten years, of a penitentiary structure dedicated to Saint-Martin, adapted to the situation of the Territory and benefiting means of the SPIP to promote reintegration ”.

Bruno Magras, president of the territorial council of Saint-Barthélemy expressed his satisfaction that this project of detached room could finally materialize and explained that the community of Saint-Barthélemy had participated financially in its construction to the tune of 450 euros "because it is part of [his] policy which consists in bringing decision-making power closer to the citizen ”.

“I know how much the expectation of litigants, legal professionals and representatives of communities like you were to have a place here that strengthens the judicial presence. This plaque, which we have just unveiled together, symbolizes the response to these legitimate expectations. By discovering it, it is a place that embodies real local justice, at the service of litigants that I wanted to highlight today ”indicated Nicole Belloubet, Minister of Justice. Nicole Belloubet then responded to the points raised by Daniel Gibbs. Thus, on the establishment of an educational center for the judicial protection of young people, she declared: “my director of judicial protection of young people was here last week to see how in this territory, we can improve the care for young people under the judicial protection of young people ”.

As for the ambition of a cooperation agreement in civil and penal judicial matters, the Keeper of the Seals assured: “As soon as I return to Paris I will speak to my office about it to try to bring this draft agreement to fruition which seems essential to speed up justice as we need to deliver it ”.

Finally, on the penitentiary aspect, and first of all on the SPIP (penitentiary integration and probation service): “I believe that we must be able, within the limits of our means, but these are means that will increase, since we are going to recruit 1500 additional SPIP staff on the national territory until 2022, so we are going from there to rethink the way of organizing the SPIP here, I am committed to it ”. As for the wish to create a penitentiary establishment, Nicole Belloubet replied, not without humor: "you have given me ten years to think about it, I intend to use this period to think about it".
