Can the COM adapt the examination of the highway code to the realities of the territory?

0

Driving without a license is an offense and people controlled by the gendarmes are summoned to court to be tried.

If some do not make any effort to try to regularize their situation, others explain having enrolled in a driving school to obtain the famous license. Among these people, some succeed and others find it difficult to pass the code because the exam is in French, yet they do not practice the language well enough to understand the meaning of the questions. "It's a real problem," admitted the deputy prosecutor at a recent correctional hearing. And had suggested a possible adaptation of the code insofar as the Collectivity has this competence. To what extent is this possible? Response elements.

What competence allows the COM to adapt the examination of the highway code?

On its passage in community, Saint-Martin obtained within the framework of the organic law of February 21, 2007, the competence giving it full powers to set the rules applicable to road traffic and road transport. The mission of the COM is thus to ensure the public service of accreditation of driving education establishments, organization of examinations, issuance of driving licenses and registration of land motor vehicles (issuance of grey).

This is confirmed by the decree of June 26, 2014, the transfer of this competence takes place on 1er July 2014.

Which COM department is in charge of examining the highway code?

The Collectivity has been in charge of the organization of theoretical exams of the code known as ETG since October 2014. The transport management of the Collective draws up the annual calendar of exam sessions and, through its driving service, ensures that due date monthly, the public service mission of organizing the ETG theoretical exams.

The driving service thus creates sessions as needed,  ensures the distribution of examination places to the ten establishments approved for teaching driving and road safety in France. The service also manages exam registration request files from free candidates.

Note that all candidates for exams organized by the Collectivity must be registered in the local driver's license file and have their application number.

The COM also materially organizes the ETG exams (animation, correction in the room, correction and updating of results files).

Can the COM decide on the content of the traffic code review?

She can. Its competence allows it to adapt the content of the examinations of the code to the realities of the territory. However, she has not done so so far. "The main objective was to preserve the conformity of the exams with the national system regularly reformed in 2014 and then in 2016, in order not to derogate from the national and European character of the title driving license issued by the president of the Collectivity", explains the service concerned.

The latter specifies that an audit of the exam is currently underway to see how to facilitate access to the exam "while maintaining what makes it a full national exam".

Is support in place for the non-French speaking public?

These drivers are accompanied by driving schools and "the Collectivity authorizes as many times as necessary, upon request from the establishments, every two months the setting up of an adapted theoretical examination". This is a manual examination with the intervention of an interpreter. Explanations in the language of the candidates are thus provided. The response time can also be extended if necessary.

Can the COM propose a "light" examination?

Yes, the Collectivité has the means to accentuate the accession process by offering a simplified examination but the title would be limited to the sole territory of the French part.

"This device, if it were to see the light of day, must be approved by the competent advisory commission, be strongly supervised and not allow people carrying out clandestine activities in the field of transport to easily obtain a local permit confining their irregular activity. only to the French part ”, explains the COM.
