Justice: Mother sentenced for regularly hitting her children

MD, born in 79 in Port au Prince, was sentenced on Thursday September 20, 2018 to six months in prison, three of which were suspended, for acts of usual violence against minors, in this case, her children.

It is the younger sibling, Y. who reports the facts in 2016 to social assistance at his school. Then aged 15, he declared that his mother beat him regularly and asked him to leave the family home. Y. explains that the violence started six years earlier. After the death of their father, he and his little brother, his big sister went to live with their mother.

Once the facts were reported to the prosecutor, the investigators interviewed the other two children. The youngest, D., confides that he is not eating enough. He feels weak at the end of the morning. "He fell in apples several times at school" reports Mrs. L., a neighbor with whom the children take refuge morning, noon and evening, to take their meals. The youngest says he has already seen his mother hitting his brother and sister. The eldest, O., 16 at the time, explains that her mother invited her to interrupt her studies to bring back money. She says that she hits her with whatever falls under her hand: broomstick, belt ... "Her mood is very changeable, for no apparent reason" she testifies.

Ms. L., with whom the children have since been placed, is the only one present at the hearing Thursday, September 20. At the helm, while the president of the court asks her to recount the violence she witnessed, she explains, with tears in her eyes, that already very young, O. was injured in the face by her mother's scratches. Talking about it costs him: "It hurts me, they have suffered a lot." Sometimes, we learn, O. is woken up in the middle of the night by her mother who asks her to do the cleaning, or goes back to her room to beat her up for no reason. In addition to physical violence, she is constantly lowering it. She sent O. to high school in Guadeloupe. She bought the plane ticket for her and gave her some money, but did not accompany her. It is Mrs. L. who takes all the steps so that O. can eat in the canteen, take the bus and have a place to stay. She even had to buy another mobile phone for the teenager because the mother sent disturbing messages to her daughter: “You are going to miss your bac”… O. nevertheless managed to get her bac with honors and has since left in mainland France continue her studies, supported by Mrs. L.

With the investigators, MD disputed the facts and simply admitted that they were scolded when they made mistakes. A medico-psychological expertise declares her accessible to a criminal sanction despite her mood disorders. MD, is absent from court. She no longer has contact with her children. She is represented by her lawyer, to whom she has declared that this case is "from ancient history". "Everyone says it, she has a mental problem. She imagines her life. She is in denial of mistreatment ”pleads the defense for whom MD is in chronic depression.

The prosecutor regrets the absence of MD and would have preferred a psychiatric expertise. However, for the prosecution there is no doubt, the offense is constituted: violence against children with the aggravating circumstance the fact that they are committed by an ascendant. He requires a six-month suspended prison sentence.

After deliberation, the court sentences MD, who has no criminal record, to six months in prison, three of which are suspended and two years of probation, an obligation to care and the ban on contacting his children. The court also receives the constitution of the victims in civil proceedings. MD must compensate them by paying 3000 euros to each of his children.
