On June 30, 2019 around 20:30 p.m. on the main road to La Savane, a pick-up is traveling in the direction of Grand Case-Marigot. He follows a car. As he passed it, he collided with a scooter coming in front which was on the side of the road.
Contrary to what has been said, “the shock was not frontal. The pick-up shows traces on its left side, ”corrected the judge. According to the testimony of the driver who was overtaken, the pick-up "took off", that is to say that it was largely to the left in the left lane when passing; the impact took place closer to the shoulder than to the middle of the taxiway. A distance of 34 meters was recorded between the point of impact and the point of immobilization of the vehicle.
On the scooter are two young people, aged 17 and 18. They are killed instantly. An investigation is opened to determine the causes and those responsible for the accident. At its end, the three passengers of the pick-up (FR, AB and DB) are returned to the local court of Saint-Martin. Their trial took place on Thursday, September 16.
• The start of the investigation
After the accident, the firefighters arrived on the scene and then the gendarmes. The deputy prosecutor is also traveling. No one is arrested or questioned the same evening; the prosecution summons the three men from the pick-up the next day. Only RF is screened and tests do not reveal any presence of alcohol in his blood.
FR states that he was driving. AB, who owns the pick-up, asked him because he had been drinking. AB is then a front passenger and DB is seated in the rear. FR says that at the Savannah, he was following a car whose driver made a sign to him to pass her. He checked the visibility in his mirrors, put on his turn signal and passed. He said he did not see the scooter coming in front. At the last moment, he stepped on the brake with both feet but could not avoid the impact.
Faced with these statements, the investigation was closed on July 3, three days later. FR is summoned to the criminal court for homicide.
