Eight months in prison for stealing a car

"I think they got the wrong person, Madam." This is the first sentence that JH pronounces at his trial. JH is a 33-year-old Saint-Martin resident who is accused of stealing a vehicle last February and driving it at excessive speed. He was summoned Thursday before the local court of Saint-Martin. He appeared by videoconference from the Basse-Terre remand center where he has been imprisoned for a little over seven months.

On February 4, the victim, DA, was loading his car in Quartier d'Orléans when suddenly JH appeared, got behind the wheel of the vehicle and fled. DA reacts immediately, jumps on his motorbike and sets off in pursuit of the thief. At the same time, DA's companion calls the gendarmes who will find the car in Bellevue where DA has hit an electrical transformer. Samples are taken inside the vehicle; the DNA found corresponds to that of JH. 

The deputy prosecutor requires one year in prison and a fine of 135 euros as well as a committal warrant; JH's criminal record, which includes ten mentions since 2011, did not work in his favor.

After deliberating, the court found JH guilty of the facts and sentenced him to eight months in prison, a fine of 135 euros and  to compensate the victim up to 3 euros for all damages combined. He also issued a warrant of committal; this means that these eight months are added to the sentence that JH is serving and prolongs his stay in prison by as much. JH was due out in February 000.
