"Chez Raymond": his request for recognition in the public domain of his plot rejected by the courts

In 2018, Louis Raymond Mussington, the manager of the restaurant Chez Raymond on the Baie Rouge beach, was convicted by the Saint-Martin criminal court for, in particular, having erected his establishment without a building permit.

In parallel with this procedure carried out by the prosecution, the association of co-owners of Terres Basses (ASL) had obtained his eviction from the land he occupied without authorization; it turned out that Raymond had built his restaurant on private land - that of the ASL - and not on the public domain of the COM. An assertion that the person has always denied.

This is why in March 2019, he seized the administrative court of Saint-Martin to ask him "to order the COM to regularize the occupation of the public domain, to note the membership of the disputed plot in the public domain and that ASL des Terres Basses is not the owner of the so-called "geometric 50 steps" area at this precise location. He also asked the court to "find that he is granted rights and pays taxes due to the COM" on this plot, including property tax.

The case was examined at a public hearing on January 23 and the court rendered its decision on February 11. The judges rejected his request on the grounds that it is not within their competence to issue injunctions to the administration and to find out what he is asking for.
