Bianca case: six months suspended prison sentence for the pediatrician and released from the surgeon

The court delivered its deliberations in the Bianca case. Two doctors, a pediatrician and a surgeon, were accused of indirectly causing the death of a young girl admitted to the hospital.

The court found the pediatrician guilty and imposed a suspended sentence of six months in prison against him. He admitted that the doctor was able to make the correct diagnosis. According to the magistrates, he was also aware of the constraints to organize a medical evacuation (Evasan) to Guadeloupe and he did not take them into account. So he couldn't "Ignore some of the risks "That he made the little girl incur by making no decision.

However, the court granted the surgeon's acquittal. Deciding on an Evasan was beyond his competence.

As regards the claims for damages, the Criminal Court rejected them to the extent that it did not have jurisdiction. This is the responsibility of the administrative court. (More details on www.soualigapost.com)
