Fatal accident: eight months in prison for the pilot of a scooter

On July 27, 2020 at 23:15 p.m., a fatal accident occurred on the Rn7 between Orient Bay and Le Galion. A scooter coming from Quartier d'Orléans collided with an oncoming vehicle. The drivers of the two-wheeler and the car survived.

The scooter passenger died the next day in hospital from his injuries.

The driver of the scooter, EJ, was prosecuted for “manslaughter by driver of a motor land vehicle committed with at least two aggravating circumstances”. He was summoned Thursday before the local court of Saint-Martin just like the civil party. But, to the surprise of the court and the prosecution, none of the parties was present.

EJ did not hold a driver's license and the scooter was uninsured. EJ was also driving under the influence of narcotics but this was not held against him. He had turned 20 three days before the accident and had received the scooter as a present from his father. 

"It's a dramatic case," said the prosecutor. Since EJ was "young" and had no mention of his criminal record, the prosecutor asked the court to enter the process of sentencing and requested a sentence of eighteen months' imprisonment, ten of which were suspended. 

After deliberation, the court declared EJ guilty of the charges against him and sentenced him to 18 months in prison, including 10 months of probation. (soualigapost.com)
